What is the Court filing fee? Can I make payments on this fee?

Currently, the court filing fee is $306. You can pay this fee in four equal installments over a four month period. I would recommend though that if you can pay the filing fee upfront that you do so.

What are your fees for a Chapter 7 bankruptcy?

A:

For a single filing, my fee is $1050 plus the filing fee (ie $1356 total). For a couple filing, my fee is $1200 plus the filing fee (i.e.. $1556 total).

Does this fee include securing my credit report?

A:

Yes, I will obtain and review all three reports with no additional fees.

Can I make payments?

Yes, you can make payments. I cannot file the bankruptcy until my fee is paid in full.

Is this a flat fee for a Chapter 7 bankruptcy?

A:

I call my fee a “flat fee plus”. By this, I mean that 99% of the time the fee is a flat fee. My fee covers the following work required for a chapter 7 bankruptcy: a) meeting with the debtors to explain the process; b) preparing the filing including review of the 3 credit reports; c) meeting with the debtors a second time to explain the filing and have the debtors sign; d) filing the petition and schedules with the court; e) collecting documents to forward to the trustee prior to the meeting with the creditors; f) attending the meeting with the creditors. In certain infrequent situations, your bankruptcy may require extra work. However, my contract does provide for an additional charge in those situations where extra work is required.

Can I keep my house and my car?

A:

In nearly every case, the answer is yes. A Chapter 7 debtor has the obligation to turnover nonexempt property to the trustee. See the link for “exempt and nonexempt property” for more details.

Most of our debt is in my name and not my wife’s name. Can I file as a single filer if I am married?

A:

Yes

Will a bankruptcy get rid of all my debt?

A:

With respect to secured debts (like a house or a car), you must continue to pay pursuant to the contract in order to keep the asset. With respect to unsecured debts like credit cards, medical bills, unsecured loans, foreclosures, repossessions, and most judgments, such debts are dischargeable.
